An interesting turn of events from Glutton Creeper Games:<blockquote>May 8th, 2007: ZeniMax Media/Bethesda has threatened to file an injunction against GCG for damages, should we not cease and deist production of Fallout PnP d20 products. They are stating that Interplay never had the rights to license a Pen and Paper to GCG under their license of Fallout from 2004 before the purchase of the IP, and makes claims against GCG that it may damage the Fallout brand and forecoming Fallout 3 release by linking the two. So for now, we have removed the page, until a resolution is met. If you want to see Fallout PnP d20 releases, please let the people at ZeniMax Media/Bethesda know, but don't send them hate mail or flames.

Our first product was being sent for review this weekend to Interplay, and still will be, as we hope Interplay will get this sorted out with Bethesda.</blockquote>Is this the end of the Glutton Creeper saga?

Great. How long before Bethesda starts making fan sites take down copyrighted fallout images, logo's, etc. claiming trademark infringment.

They can't. They've been out so long that falls under Fair Use.
This, on the other hand, is a product that will be commercially released. They *can* stop that.

Fair Use? Tell me, do you also still believe in the tooth fairy?

If they wanted something removed, they'd slap you with a DMCA takedown notice so hard you wouldn't remember your own name anymore. And if that wasn't enough, their legal department would engage you in legal battle until you were too poor to live on the street.

And for every website they would take down, a dozen new Romanian free host accounts would be created with a full backup restored.

So, just so I understand correctly. They can block newer stuff, but the older images, etc... are kinda considered in the public domain?
 
Errr, no. If something is released for profit, they can sue. If something is not for profit, they cannot.

Simplified of course.

No. Interplay made a contract with GCG before Bethesda got the rights, and thus legally that contract is still valid because at the time, Interplay still owned the rights to license out Fallout.

I dunno, they may be on to something. None of use have seen it. The big gripe last year was the artwork. But who knows, it might have great game play.
