I'm not sure Bethesda would enter in to an agreement like that with Interplay knowing it's fiscal shape. Bethesda usually takes a long time to make a CRPG. Morrowind was six years in development. Keep in mind that Interplay was broke and sunk deeper in debt just two years after selling Shiny for $56M. Bethesda basically bailed Interplay out in exchange for exclusive development and distribution rights to Fallout non-MMO games. Bethesda would also know that Interplay is poorly managed, so I'd say they have some kind of protection clause or two in the agreement. That's assuming of course that their lawyers aren't complete idiots.
 
You're right Saint. The question is the clause itself. Does it allow BethSoft to continue as per the agreement until the game is fulfilled or a transfer of the license in case of corporate failure.
 
I'd be shocked if BethSoft didn't get some sort of right of first refusal in case Interplay goes under or tries to sell the liscense outright at a later date.

That's quite obvious, but as has been found out when dealing with interplay, even obvious things sometimes go unchecked. I guess we will have to wait till interplay sinks and see...
 
Shockingly, this is actually a mildly intelligent deal. Distribution of Dark Alliance II was the only valuable revenue directly available to Interplay.

Shocker that they got it. Wonder why Atari went for it after all?

Atari went for it because Herve can now pay them , in cash, for the D&D royalties, instead of making empty promises of payment with future profits from BGDA2.

Atari has already hurt Herve as best they could. They've kept him from selling BGDA2 for over a quarter of the year, and with the upcoming release of Doom III and other big titles, who's going to notice the return of BGDA2 to the store shelves?
